Bike Valet Waiver

WAIVER, RELEASE, AND HOLD HARMLESS AGREEMENT FOR BIKE VALET

By providing personal information, including but not limited to my phone number to Two Wheel Valet ATL, I consent to the storage of my Customer Data in connection with the Services for up to 48 hours. I acknowledge that I have provided my telephone number to Two Wheel Valet ATL for the purposes of leaving my property with Two Wheel Valet ATL. 

By leaving my property with Two Wheel Valet ATL, I affirm that I am over the age of eighteen and have the legal capacity to agree to this Waiver, Release, and Hold Harmless Agreement (“Agreement”) and I represent covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under, or through me, as follows:

I acknowledge that leaving my property with Two Wheel Valet ATL involves risks (some of which I may not fully appreciate) and that property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my leaving my property with Two Wheel Valet ATL, regardless of whether or not caused in whole or in part by the negligence or other fault of Two Wheel Valet ATL, its directors, officers, employees, as well as the party that retained the services of Two Wheel Valet ATL, sponsors of the service delivered and and each of their affiliated companies (“Released Parties”).

I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known or unknown, which arise during or result from leaving my property with Two Wheel Valet ATL, regardless of whether or not caused in whole or in part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.

I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys’ fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from leaving my property with Two Wheel Valet ATL regardless of whether or not caused in whole or in part by the negligence or other fault of the Released Parties.

By way of this Agreement, I understand and agree that if I am hurt or my property is damaged during my participation in the Activity, I have waived my right to maintain a lawsuit against the Released Parties.

Marketing and Communication Consent

Permission to Use Cellphone for Valet Services:

By providing my cellphone number, I hereby grant Two Wheel Valet ATL and the event organizer as well as any sponsors (hereinafter referred to as the “Bike Valet Providers”) associated with the delivery of valet services permission to use the cellphone provided to me (hereinafter referred to as the “Cellphone”) solely for the purpose of valet services related to the event I used the bike valet at. This includes, but is not limited to, communications and activities required for the efficient operation and management of the valet service.

Consent to Receive Marketing Information:

In addition, I consent to the Bike Valet Providers using the Cellphone to send me marketing information, promotional materials, and updates related to their services, events, or products. This consent includes, but is not limited to, text messages, calls, and other forms of electronic communication as permitted by applicable laws and regulations.

Opt-Out and Data Protection:

I understand that I have the right to opt-out of receiving such marketing communications at any time by contacting each of the Bike Valet Providers directly. I also acknowledge that the Bike Valet Providers will handle my contact information in accordance with applicable data protection laws and their privacy policies.

Duration and Termination:

This consent is valid from the date and time of bike valet check in until 48 hours after the event’s conclusion or until terminated by me in writing. The Event Organizer and Sponsor agree to cease sending marketing information upon receipt of my written request for termination of this consent.

Secure Bike Parking

WAIVER, RELEASE, AND HOLD HARMLESS AGREEMENT FOR SECURE BIKE PARKING

This Waiver, Release, and Hold Harmless Agreement (the “Agreement”) is entered into by and between the person leaving their bike, scooter or any other equipment (“User”) and Two Wheel Valet ATL (“Provider”), as well as the organization that contracted Provider to provide secure bike parking services (collectively, the “Released Parties”).

1. Voluntary Participation: User acknowledges that their use of the secure bike parking facilities provided by Released Parties is wholly voluntary.

2. Assumption of Risk: User understands and agrees that the use of the secure bike parking facilities involves inherent risks, including but not limited to theft, damage, or loss of property. User voluntarily assumes all such risks, both known and unknown, even if arising from the negligence of the Released Parties.

3. Waiver and Release: In consideration for being permitted to use the secure bike parking facilities, User, on behalf of themselves and their heirs, assigns, personal representatives, and next of kin, hereby waives, releases, and discharges the Released Parties from any and all claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by User or to any property belonging to User, while using the secure bike parking facilities, regardless of whether such loss is caused by the negligence of the Released Parties or otherwise.

4. Indemnification: User agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of User’s use of the secure bike parking facilities.

5. No Guarantee of Security: User acknowledges that while the bike parking facilities are designed to be secure, the Released Parties do not guarantee the absolute security of User’s property and are not responsible for any theft, damage, or loss that may occur.

6. Severability: User agrees that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

By using the secure bike parking facilities, User acknowledges that they have read this Agreement, understand its contents, and agree to be bound by its terms. User further acknowledges that they are waiving substantial legal rights, including the right to sue, and are entering into this Agreement freely and voluntarily, without any inducement.

By leaving my property with Two Wheel Valet ATL, LLC I affirm that I am over the age of eighteen and have the legal capacity to agree to this Waiver, Release, and Hold Harmless Agreement (“Agreement”) and I represent covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under, or through me, as follows: 

I acknowledge that leaving my property with Two Wheel Valet ATL involves risks (some of which I may not fully appreciate) and that property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my leaving my property with Two Wheel Valet ATL, regardless of whether or not caused in whole or in part by the negligence or other fault of Two Wheel Valet ATL, its directors, officers, employees, as well as Atlanta Falcons Football Club, LLC, Atlanta United Football Club, LLC, AMB Sports & Entertainment, LLC and each of their affiliated companies as well as the Georgia World Congress Center Authority (“Released Parties”).

I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known or unknown, which arise during or result from leaving my property with Two Wheel Valet, regardless of whether or not caused in whole or in part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.

I further waive all rights I may have under Article 3, of Title 44 of the Official Code of Georgia Annotated and release Released Parties from all obligations and responsibilities they may have under the same.  

I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys’ fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from leaving my property with Two Wheel Valet, regardless of whether or not caused in whole or in part by the negligence or other fault of the Released Parties.

By way this Agreement, I understand and agree that if I am hurt or my property is damaged during my participation in the Activity, I have waived my right to maintain a lawsuit against the Released Parties.
